• You have the legal capacity to enter into these Terms
• You will comply with all applicable laws and regulations

TubeBoosts provides AI-powered tools to help creators generate YouTube thumbnails. Our service includes:

• AI thumbnail generation and design tools
• Template library and customization options
• Image editing and optimization features
• Export functionality for various platforms
• Credit-based usage on paid plans and optional one-time credit purchases

We reserve the right to modify, suspend, or discontinue any part of the service at any time without prior notice.

Compliance: You are responsible for ensuring your thumbnails comply with platform policies (e.g., YouTube) and applicable laws in your jurisdiction.

YouTube Policy Check Tool: TubeBoosts provides an optional YouTube Policy Check feature that scans your thumbnail prompt against YouTube's published Community Guidelines and Advertiser-Friendly Content policies. This tool is provided as guidance only and does not guarantee YouTube approval, monetization eligibility, or prevention of Community Guidelines strikes. YouTube's own automated and manual review systems make the final determination on all content. TubeBoosts accepts no liability for content decisions, demonetization, strikes, or channel actions taken by YouTube or any other platform. You remain solely responsible for reviewing and complying with all applicable platform policies before publishing.

Compliance Coverage: The checker uses a blended signal approach including text heuristics (prompt/title/style), image-level safety and logo signals, and OCR text extraction where available. Coverage includes common risk categories such as deceptive metadata, sensitive/violent content, impersonation/IP risk, medical or financial misinformation signals, child safety concerns, and AI altered-content disclosure reminders.

No Absolute Guarantee: Platform rules evolve and enforcement can vary by context, geography, timing, policy updates, and reviewer interpretation. Even when the tool reports low risk or no issues, you must perform your own final review before publishing.

User Override: TubeBoosts may allow you to continue and download even when policy warnings are present. If you choose to bypass warnings, you accept full responsibility for publishing outcomes, including monetization limits, strikes, takedowns, or account actions.

AI-Generated Content Disclosure: All thumbnails created with TubeBoosts are generated using AI. YouTube requires creators to disclose altered or synthetic content that appears realistic. It is your responsibility to use the "Altered Content" setting in YouTube Studio when uploading AI-generated thumbnails.

You agree NOT to use TubeBoosts to:

• Create misleading, deceptive, or clickbait content that violates platform policies
• Generate content that is illegal, harmful, or infringes on others' rights
• Produce thumbnails containing hate speech, violence, or explicit material
• Impersonate others or misrepresent your affiliation
• Attempt to reverse engineer, hack, or disrupt our service
• Use automated bots or scripts without permission
• Resell or redistribute our service without authorization

Marketing emails: We follow Canada's CASL and U.S. anti-spam laws. You may opt-in or opt-out of promotional communications at any time. See Privacy Policy.

Your Content:

• You retain ownership of any original content you upload
• You grant us a license to process and store your content to provide the service
• You are responsible for ensuring you have rights to any images you upload

Our Content:

• TubeBoosts' branding, design, and software are our intellectual property
• Templates and AI-generated designs may be used for your thumbnails
• You may not copy or redistribute our templates or software

DMCA/Notice: If you believe content generated through our service infringes your rights, contact support with details so we can review and, where appropriate, disable access to the material.

TubeBoosts uses third-party AI image generation services to power our thumbnail generation features.

To ensure fair access and service stability, TubeBoosts enforces technical limits, including per-user and global request limits. Limits may vary by plan and may change over time.

If you approach your limit, requests may be delayed, queued briefly, or rejected. These controls support:

• Fair access for all users
• Service reliability and uptime
• Compliance with our third-party AI provider agreements

Abuse or circumvention of rate limits may result in account suspension. For higher limits, consider upgrading your plan or contacting us for agency options.

You are responsible for maintaining the security of your account. We may suspend or terminate your account if:

• You violate these Terms of Service
• You engage in fraudulent or illegal activity
• Your account poses a security risk
• We are required to do so by law

You may delete your account at any time by contacting support.

Subscriptions & Billing: TubeBoosts plans are paid and billed in advance. Active subscriptions renew automatically unless canceled through your billing settings. Subscription credits reset each billing cycle. One-time purchased credits are added to your balance and are preserved across subscription changes and cancellation, subject to these Terms and applicable law.

Credit usage: Credits are consumed when a generation request is successfully completed and delivered. Failed generations are not intentionally charged, and operational adjustments may be applied where needed.

Refunds may be provided where required by law or at our discretion.

Results vary based on many factors including content quality, niche, and YouTube's algorithm. TubeBoosts is a design tool only.

To the maximum extent permitted by law, TubeBoosts and its creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits or revenue
• Loss of data or content
• Business interruption
• Any damages arising from use of the service

Some jurisdictions do not allow certain limitations of liability; in such cases, our liability is limited to the extent permitted by law.
